Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on State Affairs was held on Thursday, April 8, 2021, in the Capitol Extension, Room E1.028, at Austin, Texas.

Senator Charles Schwertner, the acting chair, called the meeting to order at 9:35 AM. The following business was transacted:

 

The chair laid out SB 550 and recognized the author, Senator Springer, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Schwertner moved that SB 550 be left pending; without objection, it was so ordered.

 

The chair laid out SB 825 and recognized the author, Senator Springer, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Schwertner moved that SB 825 be left pending; without objection, it was so ordered.

 

The chair laid out SB 513 and recognized the author, Senator Hall, to explain the bill.

The chair laid out SB 19 and recognized the author, Senator Schwertner, to explain the bill. The chair laid out SB 737 and recognized Senator Schwertner, in the absence of the author, to explain the bill.  Senator Hall sent up a committee substitute.  The chair recognized Senator Birdwell to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.   Senator Hughes moved that SB 737 be left pending; without objection, it was so ordered.

At 10:37 AM the committee resumed.

 

The chair laid out SB 20 and recognized the author, Senator Campbell, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Hughes moved that SB 20 be left pending; without objection, it was so ordered.

 

At 10:45 AM Senator Hughes moved that the Committee stand recessed until 1 PM or upon adjournment of the Senate. Without objection, it was so ordered. 

 

At 3:37 PM Senator Hughes reconvened the meeting.

 

The chair laid out SCR 12 and recognized the author, Senator Creighton, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Hughes moved that SCR 12 be left pending; without objection, it was so ordered.

 

The chair laid out SB 18 and recognized the author, Senator Creighton, to explain the bill. Senator Hall sent up a committee substitute.  The chair recognized Senator Creighton to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.   Senator Hughes moved that SB 18 be left pending; without objection, it was so ordered. 

 

At 4:45 PM Senator Hall assumed the chair.

 

At 5:18 PM Senator Hughes resumed the chair.

 

The chair laid out SB 18 as a matter of pending business.   Senator Hall moved that the adoption of the committee substitute; without objection, it was so ordered.  Senator Hall moved that SB 18 do not pass but that CSSB 18 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent. 

 

The chair laid out SB 19 as a matter of pending business.   Senator Hall moved that SB 19 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent.  

 

The chair laid out SB 20 as a matter of pending business.   Senator Nelson moved that SB 20 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

The chair laid out SB 513 as a matter of pending business.   Senator Campbell moved that SB 513 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent.

 

The chair laid out SB 550 as a matter of pending business SB 550.   Senator Hall moved that SB 550 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

The chair laid out SB 737 as a matter of pending business SB 737.   Senator Campbell moved that the adoption of the committee substitute; without objection, it was so ordered.  Senator Campbell moved that SB 737 do not pass but that CSSB 737 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent. 

 

The chair laid out SB 1253 as a matter of pending business.   Senator Campbell moved that SB 1253 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Senator Schwertner moved to reconsider the vote by which SB 22 was reported to the Senate; without objection, it was so ordered.  Senator Schwertner moved to reconsider the vote by which the committee substitute for SB 22 was adopted; without objection, it was so ordered.  Senator Schwertner withdrew the committee substitute to SB 22 that was adopted last week.

 

The chair laid out SCR 12 as a matter of pending business.  Senator Hall moved that SCR 12 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent.

The chair laid out SCR 17 as a matter of pending business.   Senator Hughes moved that SCR 17 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.  

 

At 5:25 PM Senator Hughes resumed the chair.

 

The chair moved adoption of Motions in Writing submitted by Senators Lucio and Powell; without objection, the motions were adopted.

 

There being no further business, at 5:27 PM Senator Hughes moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
