Amend HB 4 (house committee report) by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____. Subchapter A, Chapter 411, Government Code, is amended by adding Section 411.02098 to read as follows:
Sec. 411.02098. REPORT REGARDING PERSONS DETAINED FOR ILLEGAL ENTRY FROM FOREIGN NATION AND ILLEGAL REENTRY. (a) Not later than January 31 of each year, the department shall collect information for the preceding calendar year regarding persons arrested, detained, or removed for an offense under Chapter 51, Penal Code, including, with regard to each person arrested, detained, or removed:
(1) the reason the person was originally arrested, detained, or subject to removal proceedings;
(2) the language spoken by the person;
(3) whether the person required a translator and whether the arresting law enforcement agency provided a translator to the person;
(4) any evidence requested by the peace officer that arrested, detained, or removed the person regarding the person's residence in the United States;
(5) any evidence presented by the person regarding the person's residence in the United States;
(6) whether the person contested removal or refused to comply with removal under Chapter 51, Penal Code;
(7) the county in which the person was arrested or detained;
(8) if the person was removed under Section 51.02(e) or 51.03(d), Penal Code, the county from which the person was removed;
(9) whether the person had children accompanying them; and
(10) the person's age, entry point into the United States, and country of origin.
(b) The department shall identify the entities that possess information required by Subsection (a) and require each entity to report the information to the department in the manner prescribed by the department.
(c) Not later than February 1 of each year, the department shall prepare and submit to the governor, the lieutenant governor, and each member of the legislature a report that:
(1) includes the information described by Subsection (a); and
(2) identifies the total number of persons arrested, detained, or removed for an offense under Chapter 51, Penal Code, during the preceding year.
