Amend HB 4 (house committee report) on page 4, between lines 17 and 18, by inserting the following:
Sec. 51.05. DETENTION IN CERTAIN COUNTY JAILS PROHIBITED. (a) This section applies only to a county jail that:
(1) the Commission on Jail Standards has determined is not in compliance with the minimum standards for county jails;
(2) is transferring prisoners pursuant to a contract entered into by a county with another political subdivision to confine the county's prisoners; or
(3) is at full capacity for purposes of confining prisoners.
(b) A person arrested for an offense under this chapter may not be detained in a facility described by Subsection (a).
