Amend SB 4 (house committee printing) as follows:

(1)  On page 4, line 10, strike "Subsection (b)" and substitute "Subsections (b) and (c)".

(2)  On page 6, line 8, strike "third" and substitute "fourth".

(3)  On page 6, line 9, strike "third" and substitute "fourth".

(4)  On page 6, between lines 12 and 13, insert the following:

(c)  It is an affirmative defense to prosecution of an offense under this section, other than an offense punishable under Subsection (b)(1)(A) or (b)(2), that the actor is related to the smuggled individual within the third [second] degree of consanguinity or, at the time of the offense, within the third [second] degree of affinity.
