Amend CSHB 2127 (house committee printing) as follows:
(1)  On page 6, line 7, strike "Unless" and substitute "Except as provided by Subsection (c), unless".
(2)  On page 6, between lines 17 and 18, insert the following:
(c)  A municipality or county may adopt, enforce, or maintain an ordinance, order, or rule related to this code, regardless of whether the ordinance, order, or rule is adopted before, on, or after September 1, 2023, if the ordinance, order, or rule:
(1)  regulates a contract or agreement entered into between a private entity and a governmental entity;
(2)  relates to terms of employment in a contract or agreement entered into between a private employer or entity, including an entity representing municipal or county employees, and a governmental entity;
(3)  is consistent with the standards and recommendations relating to heat and workforce safety contained in the version as of April 18, 2023, of the Criteria for a Recommended Standard: Occupational Exposure to Heat and Hot Environments published by the National Institute for Occupational Safety and Health;
(4)  seeks to educate workers, employers, or the public about wage theft, as defined by this code, the Penal Code, or the Fair Labor Standards Act of 1938 (29 U.S.C. Section 201 et seq.); or
(5)  prohibits any adverse treatment, harassment, or limitation on the basis of an individual's actual or perceived membership in a class protected by the ordinance, order, or rule.
