Amend CSHB 2127 (house committee printing) on page 6 as follows:
(1) On line 7, strike "Unless" and substitute "Except as provided by this section, unless".
(2) Between lines 17 and 18, insert the following appropriately lettered subsection:
(____) This section does not apply to an ordinance, order, or rule that prohibits sexual harassment, including an unwelcome sexual advance, request for sexual favor, or any other verbal or physical contact of a sexual nature, if:
(1) submission to the advance, request, or contact is made a term of an individual's employment;
(2) submission to or rejection of the advance, request, or contact is used as the basis for a decision affecting an individual's employment; or
(3) the advance, request, or contact:
(A) has the purpose of interfering with an individual's employment; or
(B) has the purpose or effect of creating an intimidating, hostile, or offensive working environment.
