Amend CSHB 3615, in Section 4 of the bill, on page 2, lines 26-27 and page 3, lines 1-2, by replacing Subsection 604A.004(b) with the following:
(b) Before a merchant may impose a surcharge under this section, the merchant must provide to a buyer who uses a credit card for an extension of credit a disclosure stating: "The payment of a credit card surcharge is the responsibility of the cardholder."
