Amend SB 2 (senate committee report) as follows:
(1) In the recital to SECTION 1 of the bill (page 1, lines 24-25), strike "Sections 64.012(a) and (b), Election Code, are amended" and substitute "Section 64.012, Election Code, is amended by amending Subsections (a) and (b) and adding Subsection (e)".
(2) In SECTION 1 of the bill, immediately following amended Section 64.012(b), Election Code (page 1, between lines 44 and 45), insert the following:
(e) It is an affirmative defense to prosecution under this section that:
(1) the person's ballot was not finally counted; or
(2) the person engaged in the conduct constituting the offense at the direction of an election official, including by being issued a registration certificate under Section 13.142.
