Amend CSSB 8 (senate committee report), in SECTION 1.002 of the bill, amending Section 11.161, Education Code, as follows:

(1) On page 1, line 46, between "PROCEEDING." and "In", insert "(a)".

(2) On page 1, between lines 56 and 57, insert the following appropriately lettered subsection:

(_) This section does not apply to a civil suit or administrative proceeding brought under the Individuals with Disabilities Education Act (20 U.S.C. Section 1400 et seq.). A civil suit or administrative proceeding described by this subsection is governed by the attorney's fees provisions under 20 U.S.C. Section 1415.
