Amend CSSB 1039 (senate committee report) as follows:
(1) In SECTION 1 of the bill, immediately following added Section 280.002(f), Election Code (page 2, between lines 42 and 43), insert the following:
(g) The county clerk or other authority conducting an election may challenge a determination under this section by the secretary of state that a violation of this code has occurred in the appropriate district court not later than the 30th day after the date the clerk or other authority receives a notice under Section 280.003(a). Sovereign immunity is waived for purposes of a challenge under this subsection.
(2) In SECTION 1 of the bill, in added Section 280.003(b), Election Code (page 2, line 51), immediately following "notice", insert "or the date the county clerk's or other authority's action under Section 280.002(g) is brought to final disposition, whichever is later".
