AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 113 amends current law relating to the use of community health workers in Medicaid managed care.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter A, Chapter 533, Government Code, by adding Section 533.021, as follows:

 

Sec. 533.021. COMMUNITY HEALTH WORKERS. (a) Defines "community health worker."

 

(b) Requires the Health and Human Services Commission to allow each Medicaid managed care organization providing health care services under the STAR Medicaid managed care program to categorize services provided by a community health worker as a quality improvement cost, as authorized by federal law, instead of as an administrative expense.

 

SECTION 2. Requires a state agency, if necessary for implementation of a provision of this Act, to request a waiver or authorization from a federal agency, and authorizes a delay of implementation until such a waiver or authorization is granted.

 

SECTION 3. Effective date: upon passage or September 1, 2023.
