BACKGROUND AND PURPOSE

Certain counties are in need of grant programs for funding public improvement projects to benefit unincorporated communities located within the counties. H.B. 1330 addresses this need by providing for certain counties to establish and implement a grant program for the purpose of funding such public improvement projects. H.B. 1330 also allows such a county to accept gifts, grants, or donations to fund the public improvement projects. 

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1330 amends the Local Government Code to authorize the commissioners court of a county that meets the following criteria to establish and implement by order a grant program for the purpose of funding public improvement projects to benefit unincorporated communities located in the county:

· the county has a population of not more than 3,000;

· the county is adjacent to at least three counties with populations of less than 10,000; and

· the county is located on an international border.

The bill authorizes the county to apply for and accept a gift, grant, or donation from any source to fund an applicable public improvement project, which includes the following:

· the acquisition, construction, or improvement of:

o sidewalks, streets, roads, or other transportation infrastructure;

o water, wastewater, or drainage facilities or improvements; or

o other public facilities or improvements; and

· special supplemental services for improvement and promotion of the area, including services relating to advertising, promotion, health and sanitation, water and wastewater, public safety, security, business recruitment, development, recreation, and cultural enhancement.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2023.
