BACKGROUND AND PURPOSE

 

Under current law, an agricultural operation may be subject to municipal regulations relating to

the height or maintenance of vegetation, which may effectively limit the operation's production.

C.S.H.B. 1389 seeks to limit governmental requirements on such an operation and encourage

increased production by exempting vegetation growing within the boundaries of an agricultural

operation from a governmental requirement of a city relating to the height or maintenance of

vegetation.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

ANALYSIS

 

C.S.H.B. 1389 amends the Agriculture Code to exempt vegetation growing within the boundaries of an agricultural operation from a governmental requirement of a city relating to the height or maintenance of vegetation.

While C.S.H.B. 1389 may differ from the introduced in minor or nonsubstantive ways, the following summarizes the substantial differences between the introduced and committee substitute versions of the bill. Whereas the introduced exempted an agricultural operation from a governmental requirement of a city relating to the height or maintenance of vegetation, the substitute clarifies that the vegetation must remain within the boundaries of the agriculture operation.
