BACKGROUND AND PURPOSE

 

Currently, the eyelash extension specialist license does not confer the authority to provide services that alter the shape or color of a person's eyelashes, commonly referred to as an eyelash "lift and tint." Under current statute, someone that wishes to provide this service must hold an esthetician license or cosmetology license, which require 750 or 1,000 hours of instruction, respectively. However, many practitioners prefer to only perform lash services, rather than additional cosmetology services, and the eyelash extension specialist license only requires 320 hours of instruction. Training courses to provide lifts and tint services are readily available, and many eyelash extension specialist license holders are already performing this service without a cosmetology or esthetician license. H.B. 3029 seeks to expand the scope of the eyelash extension specialist license to include services that alter the shape or color of a person's eyelashes using a cosmetic preparation or appliance and rename it as the eyelash specialist license.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3029 amends the Occupations Code to include altering the shape or color of a person's eyelashes using a cosmetic preparation or appliance among the services that are included as part of the practice of cosmetology and that may be performed under the scope of what is currently known as an eyelash extension specialist license. Accordingly, the bill updates references to an eyelash extension specialist license and an eyelash extension specialty establishment under statutory provisions regulating barbering and cosmetology by removing "extension" from those terms.
