BACKGROUND AND PURPOSE
The Texas Energy Reliability Council (TERC) is required to submit biennial reports to the state legislature on the state electricity supply chain's reliability and stability. Accuracy and quality are paramount in these reports, so TERC should be provided enough time as needed to meet a high standard. TERC is currently obligated to submit a legislative report by November 1 of each even-numbered year, but the state legislature does not begin meeting until the following January. This leaves about a month, still compensating for potential delays, in which TERC could work to improve and update their report while the legislature is not yet in session. H.B. 3096 seeks to change the deadline to submit its report to the legislature to December 1 of each even-numbered year. Allowing TERC an extra month to work would increase the overall quality of the report and provide for any updates which may crop up during that November.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 3096 amends the Government Code to change the deadline for the Texas Energy Reliability Council to submit its biennial legislative report on the reliability and stability of the electricity supply chain from November 1 of each even-numbered year to December 1 of each even‑numbered year. The bill applies only to a report submitted on or after the bill's effective date.
