BACKGROUND AND PURPOSE

 

The term "pass" is used in various sections of the Transportation Code to govern specific driving behaviors, but it requires clarification. H.B. 3126 seeks to ensure that only intended circumstances are governed by the terms "pass" and "passing" with regard to the rules of the road by including a specification in the definitions that returning to the original lane of travel is part of that maneuver.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3126 amends the Transportation Code to include a specification in the definitions of "pass" or "passing," for purposes of statutory provisions relating to the operation and movement of vehicles, that returning to the original lane of travel is part of that maneuver.
