AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The laws requiring stopping at an intersection differs in various statutes. H.B. 3558 seeks to clarify the place at which a vehicle needs to stop at an intersection with a stop sign by making the statutory language consistent with a similar statute that relates to a vehicle stopping at an intersection with a flashing signal and clarifying the place at which the operator of a vehicle must stop at an intersection with a stop sign depending on the presence of a clearly marked stop line or crosswalk.

 

H.B. 3558 amends current law relating to the operation of a motor vehicle at an intersection with a stop sign.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 544.010(c), Transportation Code, as follows:

 

(c) Requires an operator required to stop by Section 544.010 (Stop Signs and Yield Signs) to stop at a clearly marked stop line, rather than stop before entering the crosswalk on the near side of the intersection. Requires the operator, in the absence of a clearly marked stop line, to stop before entering the crosswalk on the near side of the intersection, rather than in the absence of a crosswalk, to stop at a clearly marked stop line. Requires the operator, in the absence of a clearly marked stop line or crosswalk, to stop at the place nearest the intersecting roadway where the operator has a view of approaching traffic on the intersecting roadway.

 

SECTION 2. Effective date: September 1, 2023. �
