BACKGROUND AND PURPOSE

 

Individuals with valid out-of-state driver's licenses seeking to obtain a driver's license or commercial driver's license in Texas face certain unnecessary hurdles. H.B. 3645 seeks to remove some of these hurdles, specifically with respect to the requirement to submit proof of completion of a driver's education course and certain unnecessarily burdensome requirements for obtaining an authorization to operate a motorcycle.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3645 amends the Transportation Code to exempt a person who holds a valid driver's license issued by another state from the requirement for a person who is younger than 25 to submit proof of completion of a driver education course to be eligible to obtain a Texas driver's license, if applicable. Additionally, the bill exempts a person whose valid out-of-state driver's license includes an authorization to operate a motorcycle from the requirement to furnish proof of completion of a motorcycle operator training course when applying for an original Class M license or for an original Class A, B, or C or commercial driver's license that includes an authorization to operate a motorcycle.

 

H.B. 3645 repeals a provision that sets the age at which an applicant for a driver's license is no longer required to provide proof of completion of a driver education course at 21. The bill amends the Education Code to make changes conforming to that repeal.

 

H.B. 3645 repeals Section 521.1601, Transportation Code, as added by Chapter 1253 (H.B. 339), Acts of the 81st Legislature, Regular Session, 2009.
