BACKGROUND AND PURPOSE

 

Due to an update to the Texas Department of Motor Vehicles online system, dealers are prevented from issuing an eTAG for vehicles that were sold without a current inspection over the past 180 days prior to the date of sale. The implementation of this update caused America Can! Cars for Kids, a nonprofit auto auction based in Dallas, Texas, to lose the ability to sell all of their vehicles to the public, which decreased the amount of funds they could distribute to their benefactors to help kids. C.S.H.B. 4226 seeks to address the issue of a nonprofit organization's ability to continue their mission by selling vehicles without a current inspection by authorizing the issuance and display of a motor vehicle buyer's tag without satisfying compulsory vehicle inspection requirements for a vehicle that is purchased at a public auction if the seller is a nonprofit organization.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 4226 amends the Transportation Code to authorize the issuance and display of a motor vehicle buyer's tag without satisfying compulsory vehicle inspection requirements under state law for a vehicle that is purchased at a public auction if the seller is a nonprofit organization.

 

EFFECTIVE DATE

 

September 1, 2023.
