BACKGROUND AND PURPOSE

 

Landowners in House District 17 have suggested that the governing statutes of the Garfield Municipal Utility District No. 1 need to be amended to grant the district the power to undertake certain road projects, exclude land from the district’s boundaries, and appoint certain individuals to serve on the board of directors of the district. H.B. 5322 seeks to address this issue by providing for the district to take those actions.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 5322 amends the Special District Local Laws Code to revise provisions relating to the Garfield Municipal Utility District No. 1. The bill grants the district the power to undertake certain road projects and provides for the exclusion of specified land from district territory. The bill authorizes the district, subject to certain requirements, to issue obligations and impose property taxes to pay for an authorized road project. The bill requires the district, as soon as practicable after the bill's effective date, to hold an election to confirm the establishment of the district and to elect five initial directors in accordance with Water Code provisions.

On passage, or, if the bill does not receive the necessary vote, September 1, 2023.
