AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1136 amends Texas General and Special Laws, 50th Regular Session, to repeal Limestone County's road system enabling act, passed in 1947, and allow the county commissioners court to operate under Chapter 252 of the Texas Transportation Code.

 

The bill allows Limestone County to operate an ex officio road commissioner system, and seek voter-approved bonds for public roads and bridges maintenance within the county, without the outdated requirement of employing a county engineer that is currently in their enabling law. The bill also provides county leadership and constituents the opportunity to adopt an alternative road system as authorized in Chapter 252, Texas Transportation Code, to best fit the county's needs.

 

S.B. 1136 amends current law relating to the administration of county roads in certain counties.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 252.101(a), Transportation Code, to delete existing text providing that Subchapter B (Road Commissioner System) does not apply to Limestone County.

 

SECTION 2. Amends Section 252.201(a), Transportation Code, to delete existing text providing that Subchapter C (Road Superintendent System) does not apply to Limestone County.

 

SECTION 3. Repealer: Chapter 53 (Limestone County�Road Laws) (S.B. 270), Acts of the 50th Legislature, Regular Session, 1947.

 

SECTION 4. Effective date: September 1, 2023.
