BACKGROUND AND PURPOSE

There is a need for Limestone County to be able to operate under a road system that best fits the county's needs, and to be able to seek voter-approved bonds for road and bridge maintenance, without the outdated requirement of having to employ a county engineer to which the county is currently subject. S.B. 1136 seeks to address this issue by repealing the county's road law and removing the county's exemption from provisions relating to the road commissioner system and the road superintendent system.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 1136 amends the Transportation Code to remove the exemption for Limestone County from provisions relating to the road commissioner system and the road superintendent system.

S.B. 1136 repeals Chapter 53 (S.B. 270), Acts of the 50th Legislature, Regular Session, 1947, relating to the Limestone County road law.

EFFECTIVE DATE

September 1, 2023.
