AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

With Dallas Fort Worth International Airport (DFW) having the largest on-site parking capacity of any airport in the world, totaling to over 40,000 spaces, it is important these parking garages secure privacy for people who rely on them. Since the airport governing boards are considered governmental agencies, it is required that they provide any information they have to the public. Currently, the DFW airport parking garage collects data about a person's name, address, e-mail address, phone number, financial information, and certain information about the person's vehicle. All this information is subject to the public since the airport governing boards are required to do so.

 

S.B. 1495 protects those who park at DFW airport garages by clarifying the information open to the public that is collected by airport governing boards. This provides visitors with security and privacy to leave their vehicle at the airport. S.B. 1495 would make personal identifying information confidential and not subject to disclosure as stated in the Government Code under Chapter 552. S.B. 1495 seeks to address this issue by excepting from disclosure under state public information certain personal information collected by the airport parking facility. The exempted information would include an airport parking facility customer's name, email address, phone number, information about the person's vehicle, and zip code.

 

Key Provisions:

C.S.S.B. 1495 amends current law relating to the confidentiality of certain information collected by certain local governments and airport governing boards at a parking facility.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter B, Chapter 22, Transportation Code, by adding Section 22.028, as follows:

 

Sec. 22.028. CONFIDENTIALITY OF CERTAIN INFORMATION COLLECTED BY LOCAL GOVERNMENT. Provides that personal identifying information collected by a local government is confidential and not subject to disclosure under Chapter 552 (Public Information), Government Code, if the information collected is in relation to a person's use of an airport parking facility that includes:

 

(1) the person's name, address, e-mail address, phone number, and zip code;

 

(2) the person's license plate number, toll tag number, and credit, debit, or other payment card number; or

 

(3) the dates the person's vehicle was parked at the facility, the date the person's vehicle exited the facility, and the amount the person paid to park in the facility.

 

SECTION 2. Amends Section 22.091, Transportation Code, as follows:

 

Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION COLLECTED BY JOINT BOARD. Provides that personal identifying information collected by a joint board for which the constituent agencies are populous home-rule municipalities is confidential and not subject to disclosure under Chapter 552, Government Code, if the information collected is in relation to:

 

(1) a commercial online payment system and includes a person's:

 

(A) redesignates existing Subdivision (1) as Paragraph (A);

 

(B) redesignates existing Subdivision (2) as Paragraph (B);

 

(C) redesignates existing Subdivision (3) as Paragraph (C); or

 

(2) a person's use of an airport parking garage that includes:

 

(A) the person's name, e-mail address, phone number, and zip code;

 

(B) the person's license plate number, toll tag number, and credit, debit, or other payment card number; or

 

(C) the dates the person's vehicle was parked in at the facility, the date the person's vehicle exited the facility, and the amount the person paid to park in the facility.

 

SECTION 3. Makes application of this Act prospective.

 

SECTION 4. Effective date: September 1, 2023.
