AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently certain retailers may only provide particular discounts in their stores.  Unfortunately, this has hindered some businesses from being able to provide coupons of their preferences to their customers.  Many business owners are hoping to offer better rates and options to their customers using retailer-backed coupons. 

 

These coupons will help customers save money, allow specialty retailers to compete against other entities that already issue and accept coupons, and enable business owners to create personalized coupons that can provide offers that cater to customers.

 

S.B. 1678 allows holders of a package store or wine only package store to offer coupons to customers, including discounts via coupons to customers.

 

As proposed, S.B. 1678 amends current law relating to discounts provided by package store and wine only package store permit holders on the purchase of alcoholic beverages.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 102.07, Alcoholic Beverage Code, by amending Subsections (c) and (d) and adding Subsection (d-1), as follows:

 

(c) Creates an exception under Subsection (d-1).

 

(d) Creates an exception under Subsection (d-1).

 

(d-1) Authorizes a holder of a package store permit or wine only package store permit to:

 

(1) offer coupons redeemable by the public for the purchase of alcoholic beverages; and

 

(2) provide a discount of any amount on the purchase of liquor using a coupon redeemable by the public.

 

SECTION 2. Effective date: September 1, 2023.
