A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring a court that sets an execution date to |
|
|
withdraw the execution date on the motion of the prosecuting |
|
|
attorney with jurisdiction over the underlying case. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 43.141, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (d-1) to read as follows: |
|
|
(d-1) The convicting court shall withdraw the order of the |
|
|
court setting a date for execution in a death penalty case on the |
|
|
motion of the attorney representing the state. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
