A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of certain counties to create a county |
|
ethics commission. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 161.001, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 161.001. APPLICABILITY OF CHAPTER. This chapter |
|
applies only to: |
|
(1) a county that: |
|
(A) has a population of 800,000 or more; |
|
(B) is located on the international border; and |
|
(C) before September 1, 2009, had a county ethics |
|
board appointed by the commissioners court; |
|
(2) a county that: |
|
(A) has a population of 425,000 or more; |
|
(B) is adjacent to a county with a population of |
|
3.3 million or more; and |
|
(C) contains a portion of the San Jacinto River; |
|
[and] |
|
(3) a county that has a population of less than 40,000 |
|
that is adjacent to a county with a population of more than 3.3 |
|
million; and |
|
(4) a county that has a population of more than 3.3 |
|
million. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
