A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to parental rights regarding a threat assessment of a |
|
student conducted by a public school's threat assessment and safe |
|
and supportive school team. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.115, Education Code, is amended by |
|
adding Subsections (f-1) and (f-2) to read as follows: |
|
(f-1) Before a team may conduct a threat assessment of a |
|
student, the team must notify the parent of or person standing in |
|
parental relation to the student regarding the assessment. In |
|
conducting the assessment, the team shall make a good faith effort |
|
to provide an opportunity for the parent or person to: |
|
(1) participate in the assessment, either in person or |
|
remotely; and |
|
(2) submit to the team information regarding the |
|
student. |
|
(f-2) After completing a threat assessment of a student, the |
|
team shall provide to the parent of or person standing in parental |
|
relation to the student the team's findings and conclusions |
|
regarding the student. |
|
SECTION 2. This Act applies beginning with the 2023-2024 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
