A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to defense of certain actions brought against election |
|
|
judges and clerks. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 32, Election Code, is amended by adding |
|
|
Subchapter Z to read as follows: |
|
|
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS |
|
|
Sec. 32.901. DEFENSE OF SUIT AGAINST ELECTION JUDGES AND |
|
|
CLERKS. A district attorney shall defend an action, including an |
|
|
action for writ of mandamus, brought against an election judge or |
|
|
election clerk that alleges that the judge or clerk violated a |
|
|
provision of this code while acting in the judge's or clerk's |
|
|
official capacity in the county served by the district attorney. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an action filed on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
