A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality or county to regulate |
|
|
the use of an appliance, system, or component that is fueled by |
|
|
natural gas or propane. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 250, Local Government Code, is amended |
|
|
by adding Section 250.014 to read as follows: |
|
|
Sec. 250.014. CERTAIN REGULATIONS OF NATURAL GAS OR PROPANE |
|
|
APPLIANCES PROHIBITED. (a) A municipality or county may not adopt |
|
|
or enforce an ordinance, order, or other regulation that prohibits |
|
|
or restricts, directly or indirectly, the use of an appliance, |
|
|
system, or component that is fueled by natural gas or propane in the |
|
|
construction, renovation, maintenance, or alteration of a |
|
|
residential or commercial building. |
|
|
(b) This section does not prohibit a municipality or county |
|
|
from using an appliance, system, or component powered by any energy |
|
|
source on property owned by the municipality or county. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
