A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to status notifications provided by the Parks and Wildlife |
|
Department to a person who submits a rulemaking petition or |
|
accessibility complaint. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
|
Code, is amended by adding Section 11.01645 to read as follows: |
|
Sec. 11.01645. STATUS NOTIFICATIONS REGARDING PETITION FOR |
|
ADOPTION OF RULES. (a) The department shall notify a person who |
|
submits a petition under Section 2001.021, Government Code, of the |
|
status of the petition at least once every 15 days until the |
|
commission initiates a rulemaking proceeding under Section |
|
2001.021(c), Government Code, or the petition is denied. |
|
(b) If the commission initiates a rulemaking proceeding |
|
under Section 2001.021(c), Government Code, the department shall |
|
notify the person described by Subsection (a) of the status of the |
|
proceeding at least once every 15 days until a final rule is adopted |
|
or a proposed rule is withdrawn in the proceeding. |
|
(c) The notification requirements of this section are in |
|
addition to any other notice requirements prescribed by commission |
|
rules or other law. |
|
SECTION 2. The heading to Section 11.0165, Parks and |
|
Wildlife Code, is amended to read as follows: |
|
Sec. 11.0165. COMPLAINTS; STATUS NOTIFICATIONS. |
|
SECTION 3. Section 11.0165(c), Parks and Wildlife Code, is |
|
amended to read as follows: |
|
(c) Except as otherwise provided by this subsection, the |
|
[The] department shall periodically notify the complaint parties of |
|
the status of the complaint until final disposition unless the |
|
notice would jeopardize an investigation. The department shall |
|
notify a person who submits an accessibility complaint to the |
|
department pursuant to the Americans with Disabilities Act of 1990 |
|
(42 U.S.C. Section 12101 et seq.) of the status of the complaint at |
|
least once every 15 days until final disposition. |
|
SECTION 4. This Act takes effect September 1, 2023. |
