A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality to regulate |
|
|
veterinarians. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 215, Local Government |
|
|
Code, is amended by adding Section 215.007 to read as follows: |
|
|
Sec. 215.007. VETERINARIANS. (a) In this section, |
|
|
"practice of veterinary medicine" and "veterinarian" have the |
|
|
meanings assigned by Section 801.002, Occupations Code. |
|
|
(b) Unless expressly authorized by law, a municipality may |
|
|
not adopt or enforce an ordinance, rule, or regulation that: |
|
|
(1) regulates the practice of veterinary medicine; or |
|
|
(2) prohibits a veterinarian from performing a |
|
|
procedure on an animal that is not prohibited under Chapter 801, |
|
|
Occupations Code, or other law. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
