A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to criminal background check requirements for judges to |
|
access vital records maintained by the Department of State Health |
|
Services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 191.071(b), Health and Safety Code, is |
|
amended to read as follows: |
|
(b) The department may adopt a policy waiving the |
|
requirement of a fingerprint-based background check for: |
|
(1) a person who previously submitted to a |
|
fingerprint-based background check as a condition of licensure by a |
|
state agency; or |
|
(2) a person serving as a judge or justice of the |
|
supreme court, the court of criminal appeals, a court of appeals, a |
|
district court, a criminal district court, a constitutional county |
|
court, a statutory county court, a justice court, or a municipal |
|
court. |
|
SECTION 2. This Act takes effect September 1, 2023. |
