A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of a county or municipality to require
  removal of graffiti from private property.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 250.006(c), Local Government Code, is
  amended to read as follows:
         (c)  The order or ordinance must require a property owner to
  remove the graffiti on or before the 10th [15th] day after the date
  the property owner receives notice under Subsection (a). If the
  property owner fails to remove the graffiti on or before the 10th
  [15th] day after the date of receipt of the notice, the county or
  municipality may remove the graffiti and charge the expenses of
  removal to the property owner in accordance with a fee schedule
  adopted by the county or municipality.
         SECTION 2.  Section 250.006(b), Local Government Code, is
  repealed.
         SECTION 3.  The change in law made by this Act applies only
  to an order or ordinance adopted on or after the effective date of
  this Act. An order or ordinance adopted before the effective date
  of this Act is governed by the law in effect on the date the order or
  ordinance was adopted, and that law is continued in effect for that
  purpose.
         SECTION 4.  This Act takes effect September 1, 2023.
