A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the reimbursement of excess costs incurred by a |
|
|
recipient of certain grants awarded by the Texas Department of |
|
|
Transportation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 201, Transportation Code, |
|
|
is amended by adding Section 201.713 to read as follows: |
|
|
Sec. 201.713. REIMBURSEMENT OF EXCESS COSTS INCURRED BY |
|
|
CERTAIN GRANT RECIPIENTS. (a) This section applies only to a grant |
|
|
awarded by the department for the construction of a transportation |
|
|
project in a county with a population of less than 25,000 or a |
|
|
municipality with a population of less than 15,000. |
|
|
(b) The department shall reimburse a grant recipient for |
|
|
costs incurred by the recipient that exceed the amount of the grant |
|
|
awarded by the department if the construction of the transportation |
|
|
project is managed by the department. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a grant awarded by the Texas Department of Transportation on or |
|
|
after the effective date of this Act. A grant awarded before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date the award was made, and the former law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
