A BILL TO BE ENTITLED
 
AN ACT
  relating to personnel training requirements for nursing facilities
  and assisted living facilities that advertise an Alzheimer's care
  unit or memory care unit.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 242, Health and Safety
  Code, is amended by adding Section 242.2015 to read as follows:
         Sec. 242.2015.  TRAINING REQUIREMENT FOR FACILITY PERSONNEL
  PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. A nursing
  facility may not advertise, market, or otherwise promote the
  facility's Alzheimer's care unit or memory care unit as providing
  services to residents with Alzheimer's disease and related
  disorders unless the facility provides the services through
  specially trained personnel who have successfully completed a
  minimum of four training hours in caring for those residents as
  prescribed by commission rule.
         SECTION 2.  Subchapter B, Chapter 247, Health and Safety
  Code, is amended by adding Section 247.0297 to read as follows:
         Sec. 247.0297.  TRAINING REQUIREMENT FOR FACILITY PERSONNEL
  PROVIDING ALZHEIMER'S CARE; PROHIBITED ADVERTISEMENT. An assisted
  living facility may not advertise, market, or otherwise promote the
  facility's Alzheimer's care unit or memory care unit as providing
  services to residents with Alzheimer's disease and related
  disorders unless the facility provides the services through
  specially trained personnel who have successfully completed a
  minimum of four training hours in caring for those residents as
  prescribed by commission rule.
         SECTION 3.  Not later than December 1, 2023, the executive
  commissioner of the Health and Human Services Commission shall
  adopt the rules necessary to implement the changes in law made by
  this Act.
         SECTION 4.  The changes in law made by this Act apply only to
  advertising, marketing, or promoting conducted on or after January
  1, 2024.
         SECTION 5.  This Act takes effect September 1, 2023.
