A BILL TO BE ENTITLED
 
AN ACT
  relating to the eligibility for free prekindergarten programs in
  public schools of certain children who are eligible for the
  subsidized child-care program administered by the Texas Workforce
  Commission.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 29.153, Education Code, is amended by
  adding Subsection (b-1) to read as follows:
         (b-1)  Notwithstanding Subsection (b), any child who is at
  least three years of age is eligible for enrollment in a
  prekindergarten class under this section if:
               (1)  the class is provided through a partnership
  between a school district or open-enrollment charter school and a
  community-based child-care provider described by Subsection (g);
  and
               (2)  the child is eligible for subsidized child-care
  services provided through the child-care services program
  administered by the Texas Workforce Commission.
         SECTION 2.  Section 29.153(b-1), Education Code, as added by
  this Act, applies beginning with the 2023-2024 school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
