A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to civil liability of irrigation districts for the |
|
|
recreational use of district land. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 75.002, Civil Practice and Remedies |
|
|
Code, is amended by adding Subsection (f-1) to read as follows: |
|
|
(f-1) An irrigation district is not liable for injury to an |
|
|
individual or property arising from the recreational use of the |
|
|
district's land unless the injury arises from an act or omission of |
|
|
the district that constitutes recklessness or intentional |
|
|
misconduct. |
|
|
SECTION 2. Section 75.002(f-1), Civil Practice and Remedies |
|
|
Code, as added by this Act, applies only to a cause of action that |
|
|
accrues on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
