A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a local option election on the sale of alcoholic |
|
|
beverages in certain areas of a municipality and the local |
|
|
regulation of premises in those areas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 251.742, Alcoholic Beverage Code, is |
|
|
amended by amending Subsection (b) and adding Subsection (i) to |
|
|
read as follows: |
|
|
(b) This section applies only to a municipality that: |
|
|
(1) has a population of 15,000 or more[;] and |
|
|
[(2)] is located in two counties one of which: |
|
|
(A) has a population of 340,000 or more; and |
|
|
(B) borders the Gulf of Mexico; or |
|
|
(2) has a population of 240,000 or more and: |
|
|
(A) is located in two or more counties; and |
|
|
(B) borders a man-made lake that has a surface |
|
|
area of at least 20,000 acres. |
|
|
(i) Subject to Chapter 211, Local Government Code, the |
|
|
governing body of the municipality may adopt zoning and land use |
|
|
regulations applicable to a premises that sells alcoholic beverages |
|
|
in the boundaries of a zone designated under this section. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
