A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the compilation and reporting of statistics involving |
|
sexual assault victims who receive a forensic medical examination |
|
before reporting the assault to law enforcement. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter G, Chapter 56A, Code of Criminal |
|
Procedure, is amended by adding Article 56A.3031 to read as |
|
follows: |
|
Art. 56A.3031. DELAYED REPORTING BY SEXUAL ASSAULT VICTIMS; |
|
COMPILATION OF STATISTICS. (a) In this article, "department" |
|
means the Department of Public Safety. |
|
(b) The department shall compile and maintain statistics on |
|
the number of victims of sexual assault in each calendar year who |
|
have reported the sexual assault to a law enforcement agency after |
|
receiving a forensic medical examination under Article 56A.303, |
|
regardless of the year in which that examination was performed. |
|
Statistics compiled and maintained under this subsection may not |
|
include identifying information of a victim. |
|
(c) Not later than September 1 of each even-numbered year, |
|
the department shall: |
|
(1) report the statistics compiled by the department |
|
under Subsection (b) to the standing committees of the house of |
|
representatives and senate with primary jurisdiction over criminal |
|
justice issues; and |
|
(2) post the statistics compiled by the department |
|
under Subsection (b) on the department's Internet website. |
|
SECTION 2. This Act takes effect September 1, 2023. |
