A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to authorizing certain political subdivisions to change |
|
the date on which the general election for officers is held. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 41.0052, Election Code, is amended by |
|
adding Subsections (a-1) and (a-2) to read as follows: |
|
(a-1) The governing body of a political subdivision, other |
|
than a county or municipal utility district, that holds its general |
|
election for officers on the November uniform election date may, |
|
not later than December 31, 2024, change the date on which it holds |
|
its general election for officers to the May uniform election date. |
|
(a-2) Subsection (a-1) applies only to a municipality: |
|
(1) with a population of more than 30,000; |
|
(2) through which State Highway 121 runs; and |
|
(3) that is wholly located in a county with a |
|
population of more than 500,000 that borders two counties, each of |
|
which has a population of more than 2 million. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
