A BILL TO BE ENTITLED
 
AN ACT
  relating to a requirement that certain students, interns,
  residents, and fellows receiving a clinical education at public or
  nonprofit hospitals receive an annual comprehensive health
  examination.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 312.004(d), Health and Safety Code, is
  amended to read as follows:
         (d)  Except as otherwise provided by this chapter, the [The]
  contracting parties may determine the terms of and the
  consideration for a contract authorized under this section.
         SECTION 2.  Chapter 312, Health and Safety Code, is amended
  by adding Section 312.0045 to read as follows:
         Sec. 312.0045.  REQUIRED CONTRACT PROVISION: HEALTH
  EXAMINATION. A contract under Section 312.004 must require each
  student, intern, resident, and fellow who is enrolled at a
  contracting medical or dental unit or supported medical or dental
  school and who is receiving a clinical education at a public or
  nonprofit hospital to undergo at least one comprehensive health
  examination each year. The public or nonprofit hospital at which
  the student, intern, resident, or fellow is receiving the clinical
  education must offer to provide the examination at no charge and
  provide the student, intern, resident, or fellow with a day off on
  which to receive the examination. A public or nonprofit hospital
  may not reduce the amount of the compensation paid by the hospital
  to the student, intern, resident, or fellow, if any, for time off
  taken for the examination.
         SECTION 3.  The change in law made by this Act applies only
  to a contract entered into on or after the effective date of this
  Act. A contract entered into before the effective date of this Act
  is governed by the law in effect on the date the contract was
  entered into, and the former law is continued in effect for that
  purpose.
         SECTION 4.  This Act takes effect September 1, 2023.
