A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a report on recidivism rates. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 322, Government Code, is amended by |
|
|
adding Section 322.0195 to read as follows: |
|
|
Sec. 322.0195. RECIDIVISM REPORT. (a) The board shall |
|
|
prepare a biennial report on recidivism that includes rearrest, |
|
|
reconviction, and reincarceration rates. The report must include: |
|
|
(1) statewide rates and rates for each county in this |
|
|
state; and |
|
|
(2) information regarding: |
|
|
(A) individuals who have served any part of a |
|
|
sentence in a county jail; and |
|
|
(B) individuals who are rearrested, reconvicted, |
|
|
or reincarcerated in other states. |
|
|
(b) In preparing the report, the board shall collaborate |
|
|
with the Department of Public Safety. The Department of Public |
|
|
Safety shall provide any information requested by the board for the |
|
|
purpose of preparing the report. |
|
|
(c) The report may be included in any other report made by |
|
|
the board. |
|
|
(d) Not later than December 1 of each even-numbered year, |
|
|
the board shall submit the report to the governor, lieutenant |
|
|
governor, and each member of the legislature. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
