A BILL TO BE ENTITLED
 
AN ACT
  relating to the acceptance of gifts, grants, and donations by the
  Texas Department of Insurance and the office of public insurance
  counsel for employee training or education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 31, Insurance Code, is
  amended by adding Section 31.046 to read as follows:
         Sec. 31.046.  ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS FOR
  EDUCATION AND TRAINING OF DEPARTMENT EMPLOYEES. (a) In addition to
  money appropriated by the legislature, the department may accept
  gifts, grants, and donations from any source to provide funding for
  department employees to participate in educational events or
  trainings and for other purposes related to employee education,
  including education relating to:
               (1)  any insurance line, product, or service; or
               (2)  any other topic that may assist the department in
  performing the department's duties under Section 31.002. 
         (b)  The commissioner may adopt rules to administer this
  section.
         SECTION 2.  Subchapter C, Chapter 501, Insurance Code, is
  amended by adding Section 501.106 to read as follows:
         Sec. 501.106.  ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS
  FOR EDUCATION AND TRAINING OF OFFICE EMPLOYEES. In addition to
  money appropriated by the legislature, the office may accept gifts,
  grants, and donations from any source to provide funding for the
  public counsel or office employees to participate in educational
  events or trainings and for other purposes related to employee
  education, including education relating to:
               (1)  any insurance line, product, or service; or
               (2)  any other topic that may assist the office in
  performing the office's duties under this chapter.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
