A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the confidentiality of certain information in a peace |
|
officer's or firefighter's personnel file. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 552.102, Government Code, is amended by |
|
adding Subsection (c) to read as follows: |
|
(c) The following information in a peace officer's or |
|
firefighter's personnel file is confidential and excepted from the |
|
requirements of Section 552.021: |
|
(1) an application for employment; |
|
(2) information related to the process of hiring the |
|
peace officer or firefighter; and |
|
(3) a letter, memorandum, or other document relating |
|
to alleged misconduct by the peace officer or firefighter if the |
|
employing department: |
|
(A) determines that there is insufficient |
|
evidence to sustain the charge of misconduct; or |
|
(B) did not take disciplinary action against the |
|
peace officer or firefighter for the alleged misconduct. |
|
SECTION 2. The change in law made by this Act applies to |
|
information produced or maintained before, on, or after the |
|
effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2023. |
