A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the procurement procedure for certain purchases related |
|
|
to county roads in certain counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 251, Transportation Code, |
|
|
is amended by adding Section 251.020 to read as follows: |
|
|
Sec. 251.020. PROCUREMENT PROCEDURE FOR CERTAIN PURCHASES |
|
|
RELATED TO COUNTY ROADS IN CERTAIN COUNTIES. (a) This section |
|
|
applies only to a county with a population of less than 100,000. |
|
|
(b) To the extent permitted by federal law, and |
|
|
notwithstanding any other law, for a purchase of materials that is |
|
|
related to the construction or maintenance of a county road, a |
|
|
county to which this section applies is not required to use a |
|
|
procurement procedure that is required by: |
|
|
(1) the department; |
|
|
(2) commission rule; or |
|
|
(3) Subtitle B, Title 6. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
