A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to imposing a civil penalty for a violation of the Election |
|
Code. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 273, Election Code, is amended by adding |
|
Subchapter F to read as follows: |
|
SUBCHAPTER F. CIVIL PENALTY |
|
Sec. 273.101. CIVIL PENALTY. (a) In addition to any other |
|
applicable civil or criminal penalty, a person who commits an |
|
offense prescribed by the election laws of this state is liable to |
|
this state for a civil penalty. The attorney general may bring an |
|
action to recover a civil penalty imposed under this section. |
|
(b) Unless otherwise provided by a provision of this code, a |
|
civil penalty imposed under this section shall be not less than |
|
$100,000. |
|
(c) A civil penalty collected by the attorney general under |
|
this section shall be deposited in the state treasury to the credit |
|
of the general revenue fund. |
|
SECTION 2. This Act takes effect September 1, 2023. |
