A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the effect of the amendment of certain documents |
|
|
incorporated by reference into the laws or policy of this state on |
|
|
related state agency rules. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 2001, Government Code, is |
|
|
amended by adding Section 2001.008 to read as follows: |
|
|
Sec. 2001.008. EFFECT OF AMENDMENT OF DOCUMENTS |
|
|
INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the |
|
|
manner provided by this chapter shall readopt, readopt with |
|
|
amendments, or repeal a previously adopted rule if: |
|
|
(1) the rule implements, interprets, or prescribes a |
|
|
law or policy of this state that incorporates by reference a |
|
|
document that is not another law or policy of this state; and |
|
|
(2) as a result of an amendment to the document that is |
|
|
incorporated by reference into the law or policy the rule |
|
|
implements, interprets, or prescribes, the rule would: |
|
|
(A) allow the agency to expand its regulatory |
|
|
authority over a matter that involves a major question of state |
|
|
policy; or |
|
|
(B) impose a greater economic burden on persons |
|
|
required to comply with the rule or on the economy of this state. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
