A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the jurisdiction of a juvenile court over certain |
|
|
children. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 51.02(2), Family Code, is amended to |
|
|
read as follows: |
|
|
(2) "Child" means a person who is: |
|
|
(A) ten years of age or older and under 17 years |
|
|
of age; or |
|
|
(B) seventeen years of age or older and under 18 |
|
|
years of age who is alleged or found to have engaged in conduct that |
|
|
violates a penal law of this state of the grade of misdemeanor |
|
|
[delinquent conduct or conduct indicating a need for supervision] |
|
|
as a result of acts committed after [before] becoming 17 years of |
|
|
age. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
conduct constituting an offense that occurs on or after the |
|
|
effective date of this Act. Conduct constituting an offense that |
|
|
occurred before that date is governed by the law in effect on the |
|
|
date the conduct occurred, and the former law is continued in effect |
|
|
for that purpose. For purposes of this section, conduct |
|
|
constituting an offense occurred before the effective date of this |
|
|
Act if any element of conduct constituting an offense occurred |
|
|
before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
