A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the right of property owners' association members to |
|
|
speak at an association or board meeting. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 209, Property Code, is amended by adding |
|
|
Section 209.00511 to read as follows: |
|
|
Sec. 209.00511. MEMBER'S RIGHT TO SPEAK AT MEETING. (a) |
|
|
Except as otherwise provided by this section, an association member |
|
|
is entitled to speak at any association meeting, including a board |
|
|
meeting, regardless of whether the meeting is held in person, |
|
|
electronically, or by telephone. |
|
|
(b) The board may place reasonable limitations on the time |
|
|
and manner in which a member is allowed to speak but may not impose |
|
|
requirements that restrict a member's ability to express the |
|
|
member's concerns. |
|
|
(c) This section does not entitle an association member to |
|
|
speak at a portion of a board meeting conducted in executive |
|
|
session. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
