A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to the authority of a county to maintain a sewer utility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 562.015, Local Government Code, is |
|
|
amended to read as follows: |
|
|
Sec. 562.015. COUNTY WATER AND SEWER UTILITY. (a) An |
|
|
affected county, as defined by Section 16.341, Water Code, may own, |
|
|
operate, or maintain a water or sewer utility in the same manner as |
|
|
a municipality under Chapter 552. |
|
|
(b) Any county may own, operate, or maintain a sewer utility |
|
|
in the unincorporated area of the county in the same manner as a |
|
|
municipality under Chapter 552. The county must comply with all |
|
|
provisions of Chapter 13, Water Code, that apply to an affected |
|
|
county. |

|
SECTION 2. This Act takes effect September 1, 2023. |
